Trump Delays Clayton DNI Hearing Until McDonald Confirmed as US Attorney

President Donald Trump announced early Wednesday that the Senate Intelligence Committee hearing on Jay Clayton's nomination to serve as director of national intelligence would not proceed as scheduled. The move ties the nomination to the confirmation of Jamie McDonald as U.S. attorney for the Southern District of New York and broader negotiations over reauthorizing Section 702 of the Foreign Intelligence Surveillance Act.

Trump stated on Truth Social that Clayton should remain in his current role until McDonald receives Senate confirmation. Bill Pulte, whom Trump named acting DNI after Tulsi Gabbard's resignation, will continue in that capacity. Pulte, who leads the Federal Housing Finance Agency, lacks background in intelligence or national security matters.

The dispute stems from recent Senate discussions on FISA reauthorization. Republicans had moved to replace Pulte with Clayton in exchange for Democratic support on extending the surveillance authority, which permits collection of foreign communications without warrants. Democrats indicated they would withhold support after the shift occurred faster than anticipated. Trump further conditioned FISA renewal on passage of the Save America Act, which includes voting security provisions.

Clayton currently serves as U.S. attorney for the Southern District of New York. McDonald, a partner at Sullivan & Cromwell, was nominated to succeed him. Senate rules on blue slips have raised questions about McDonald's confirmation timeline.

The episode illustrates how personnel decisions and legislative priorities intersect in ways that can delay institutional leadership. Pulte's interim role continues despite objections from members of both parties over his qualifications for overseeing the intelligence community. Clayton's hearing had been viewed as a step toward stabilizing the position following Gabbard's departure.

Section 702 lapsed last week after Congress failed to act. Proponents argue the authority supports counterterrorism and foreign intelligence collection, while critics have raised concerns about incidental collection of American communications and potential for misuse. Linking its renewal to unrelated voting measures adds another layer of procedural complexity.

Trump's announcement came hours before the scheduled hearing and while he attended the G7 summit in France. The Senate Intelligence Committee has not yet indicated how it will respond to the delay.
