Mamdani publicly retreated from any city-level enforcement of the ICC warrant while shifting responsibility to federal authorities that have already rejected the court’s jurisdiction. The episode highlights the gap between local political statements and the constitutional limits on municipal power in foreign affairs.
What outlets missed
Most outlets omitted that the ICC issued a parallel arrest warrant for Hamas commander Mohammed Deif on the same day as the Netanyahu warrant, a fact that places the court’s actions in fuller context. Several reports repeated the 73,000 death figure from the Gaza Health Ministry without noting it could not be independently verified by other outlets. Few pieces addressed the American Servicemembers Protection Act of 2002, which restricts local cooperation with the ICC, or the diplomatic protections under the UN Headquarters Agreement that would apply to a visiting head of government.
New York City Mayor Zohran Mamdani on Tuesday called on the federal government to arrest Israeli Prime Minister Benjamin Netanyahu under a 2024 International Criminal Court warrant, while stating that city authorities have no independent legal power to act.
Mamdani posted a video on social media in which he described Netanyahu as a war criminal and the architect of a horrific genocide against the Palestinian people. He said his administration had reviewed every legal avenue and concluded the city could not enforce the warrant if Netanyahu visits New York for the United Nations General Assembly in September. Mamdani urged federal officials to join the ICC and carry out the arrest instead.
President Donald Trump responded on Truth Social that Netanyahu will not be arrested in any way while in the United States. Netanyahu’s office called the ICC a kangaroo court with no jurisdiction and said Mamdani should focus on New York’s problems. Israeli Ambassador to the UN Danny Danon accused Mamdani of promoting Hamas propaganda.
The United States is not a party to the Rome Statute that established the ICC and does not recognize its authority. The court issued the warrant for Netanyahu and former defense minister Yoav Gallant on charges including starvation as a method of warfare and intentionally directing attacks against civilians; Israeli officials reject the charges. The same day the court also issued a warrant for Hamas military commander Mohammed Deif.
Mamdani had pledged during his mayoral campaign to seek Netanyahu’s arrest and had told The New York Times he was consulting city lawyers. Several outlets reported the 73,000 Palestinian death figure from the Gaza Health Ministry without independent verification from other sources.
