Manhattan DA Reviews Sexual Assault Claims Against Rep. Swalwell

Manhattan District Attorney Alvin Bragg's office has opened an investigation into sexual misconduct allegations against Representative Eric Swalwell, the California Democrat who has positioned himself as a leading contender for governor. The move, confirmed by prosecutors on Saturday, follows explosive reporting by the San Francisco Chronicle and CNN detailing claims from four women, including one who accuses the congressman of rape.

The most serious accusation comes from a former staffer in Swalwell's Castro Valley district office. She told the Chronicle that shortly after she was hired, Swalwell began making inappropriate sexual comments, soliciting her for sex and sending explicit messages. The woman alleged two nonconsensual sexual encounters, the first in 2019 while she was still employed by him and the second in 2024 in a New York City hotel after she had left his staff. She described both incidents as occurring while she was too intoxicated to consent and told CNN that the 2024 encounter constituted rape. Three other women have also accused Swalwell of sexual misconduct, though fewer details about their claims have been made public.

Bragg's office responded with a pointed public statement urging survivors and witnesses to come forward. "Our specially trained prosecutors, investigators and counsellors are well-equipped to help you in a trauma-informed, survivor-centered manner," the statement read. The investigation focuses in part on the alleged New York incident, giving Manhattan prosecutors jurisdiction.

Swalwell, a married father of three first elected to Congress in 2012, has forcefully denied the allegations. In a statement issued Friday, he called them "absolutely false" and said they surfaced suspiciously close to California's June primary. "For nearly 20 years, I have served the public as a prosecutor and a congressman, and have always protected women," he said. "I will defend myself with the facts and where necessary bring legal action."

The timing is undeniably damaging. Swalwell had emerged as one of the strongest candidates in a crowded field to replace term-limited Governor Gavin Newsom. His prospects now appear threatened as prominent California Democrats, including former House Speaker Nancy Pelosi, have privately and publicly urged him to withdraw from the governor's race. The scandal has handed an opening to rivals in both parties in the state's nonpartisan primary system, which advances the top two vote-getters to a November runoff regardless of party.

Adding to Swalwell's problems are separate complaints alleging he violated immigration and campaign finance rules involving his children's live-in nanny. A complaint filed with the Department of Labor accuses Swalwell and his wife Brittany of lying to keep Amanda Barbosa employed despite her lacking proper work authorization. A February complaint to the Department of Homeland Security, filed by filmmaker and activist Joel Gilbert, claims Swalwell paid the nanny with campaign funds for roughly two years while she did not have valid authorization to work. Social media photographs show Barbosa continuing to spend time with the family throughout 2023 and 2024.

The allegations arrive against the backdrop of Swalwell's already controversial political history. Former House Speaker Kevin McCarthy has again highlighted the congressman's past association with a suspected Chinese intelligence operative, an episode that drew FBI scrutiny years ago though Swalwell was not charged with wrongdoing.

Republican Representative Anna Paulina Luna of Florida said she will introduce a motion next week to expel Swalwell from Congress, arguing it would be unacceptable for him to drop his gubernatorial bid while retaining his seat. "If these allegations are serious enough to end his campaign for governor, they are serious enough to end his time in Congress," she said on Fox News.

The Manhattan investigation is in its early stages. Prosecutors have not commented on the strength of the evidence or a possible timeline. Legal observers note that cases involving years-old allegations and questions of intoxication often face evidentiary hurdles, but the involvement of a former staffer and the pattern of alleged behavior described by multiple women could complicate Swalwell's defense.

Swalwell built his national profile in part through his aggressive criticism of Donald Trump and his role on the House Intelligence Committee. He has long presented himself as a progressive voice on issues including women's rights and holding powerful men accountable. The current accusations test that public image directly.

For now, the congressman remains in the governor's race even as the political ground shifts beneath him. Democratic strategists in California say the allegations could consolidate opposition to Swalwell among women voters and party activists who have pushed for greater accountability in the wake of the #MeToo movement. Whether the Manhattan probe yields criminal charges or simply adds to the political pressure remains to be seen.

What is already clear is that a politician who once seemed poised for higher office now faces the kind of scrutiny that has ended many careers. Bragg's office has signaled it takes the claims seriously. Swalwell has promised to fight back with evidence. The voters of California, and potentially federal prosecutors, will ultimately weigh both sides.
